Process - What We Do
Overview:
1. We meet with you.
2. We get testing for your child.
3. We prepare a draft individual education plan for presentation at the IEP team meeting.
4. We attend the IEP team meeting with or without you.
5. If we get what the child needs at the IEP meeting, then we will help you monitor whether the child actually receives the agreed-upon resources and services.
a. Then we wait for the next IEP meeting and start the process again.
6. If we do not get what the child needs at the IEP meeting, then the litigation process begins.
a. We take the case through the system.
b. We start the process again at the next IEP meeting.
Details:
1. We talk with you and understand what help you want.
2. Starting with IEP eligibility, we will get free independent testing for your child when it is available, necessary and appropriate. If necessary, we will represent you at the first IEP meeting to determine if your child is eligible for benefits under the Individuals with Disabilities Education Act (IDEA). If we believe your child is unlawfully denied eligibility, we will pursue your case through the administrative, hearing, and judicial avenues required to establish eligibility.
3. We talk with you and understand what help you want.
4. We will help you prepare a proposed individualized educational plan for each IEP meeting and will attend and represent you at the meeting with the school district's teachers and officials. We will get free independent testing for your child when it is available, necessary, and appropriate.
5. If the IEP meeting does not result in an individualized plan that reflects a Free Appropriate Public Education (FAPE) in the Least Restricted Environment (LRE) for your child, then we will pursue your child's rights and remedies through the administrative, hearing, and judicial avenues required to obtain the appropriate special education resources and services for your child that will result in a FAPE in the LRE for him or her.
6. If you are already in the middle of any of the above, we will join you and assist you from that point forward.
What We Do Not Do:
We will not represent you or your child for non-special education purposes. We specifically will not represent you or your child for criminal, bankruptcy, accidents, malpractice, compensation, construction, divorce, employment, fraud, immigration, injury, insurance, estate or tax matters.
